These Terms and Conditions govern your use of the Nimba website at nimbaaa and the interior design services provided by Nimba ("we", "us", "our"), operating from 21 Jalan Tun Mohd Fuad 1, Taman Tun Dr Ismail, 60000 Kuala Lumpur. By visiting our website or engaging our services, you acknowledge and accept these terms.

1. Use of This Website

You may use this website for personal, non-commercial purposes to learn about our services and make contact with us. You agree not to:

  • Use the website in any way that breaches applicable Malaysian or international law.
  • Transmit any unsolicited or harmful communications, including spam.
  • Attempt to gain unauthorised access to any part of our website or systems.
  • Reproduce, copy, or distribute any content from this website without our written consent.

2. Services

Nimba offers three interior design services: the First Impressions Consultation (MYR 420), the Full Design & Material Story (MYR 3,300), and Crafted Execution Support (MYR 1,700). Detailed service descriptions are available on our Solutions page.

All services are subject to a formal engagement agreement signed between Nimba and the client before work commences. The scope, deliverables, timeline, and payment schedule are set out in that agreement.

3. Consultations and Enquiries

Submitting an enquiry through our contact form or contacting us by phone or email does not create a binding service agreement. A formal engagement begins only once a written agreement is signed and any applicable deposit is received. We reserve the right to decline any engagement at our discretion without obligation to provide a reason.

4. Fees, Payment, and Cancellation

Service fees are quoted in Malaysian Ringgit (MYR) and are confirmed in the written engagement agreement. Payment terms, instalment schedules, and deposit requirements are specified per project. Late payments may result in a pause of work until the outstanding amount is settled.

Cancellation policies are outlined in each engagement agreement. In general:

  • Cancellations before design work commences may be subject to a cancellation fee reflecting preparation costs.
  • Cancellations after work has begun are subject to fees proportional to the work completed.
  • Refunds, where applicable, are processed within 14 business days.

5. Intellectual Property

All design concepts, drawings, presentations, mood boards, and material stories created by Nimba remain our intellectual property until full payment has been received. Upon payment in full, you receive a licence to use the designs for the specified project only. You may not resell, sublicence, or reproduce our design work without prior written consent.

All content on this website — including text, photography, layout, and graphics — is owned by or licenced to Nimba and is protected under applicable intellectual property laws.

6. Client Responsibilities

To support effective delivery of our services, you agree to:

  • Provide accurate and complete information about your property, requirements, and budget.
  • Respond to requests for feedback or approvals within the timeframes set out in the engagement agreement.
  • Ensure that any third-party contractors or suppliers engaged at your direction comply with applicable laws and safety standards.
  • Allow Nimba reasonable access to the project site during execution phases where applicable.

7. Limitation of Liability

Nimba takes care to deliver services to a professional standard. However, to the fullest extent permitted under Malaysian law, we are not liable for:

  • Indirect, incidental, or consequential losses arising from our services or your use of this website.
  • Delays or shortfalls caused by third-party contractors, suppliers, or circumstances beyond our reasonable control.
  • Variations between 3D visualisations and finished results, given the inherent nature of custom design work.

Our total liability in any matter relating to a project shall not exceed the fees paid by you for that specific project.

8. Photography and Portfolio Use

With your permission, Nimba may photograph completed project spaces for use in our portfolio, website, and professional presentations. We will seek your written consent before using any images that identify your property or personal spaces. You may withdraw this consent at any time.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Changes to These Terms

We may update these Terms and Conditions periodically. The current version will always be available on this page. Continued use of our website or services after any update constitutes your acceptance of the revised terms.
